~Lima, Peru~ Source: ManMMA.comIn papers filed this morning at the Lima Fight Commission Offices, Phoenix FC has officially petitioned for the Commission & ManMMA to overturn the result of the controversial finish to the ManMMA Welterweight Championship fight at ManMMA 57 to a No Contest; currently recorded as TKO victory for defending champion BJ Penn. In the petition, Phoenix FC claims that challenger, Rory MacDonald, was of sound mind & body at the time of the referee/doctor stoppage of the fight. This is backed up by medical & neurological assessments done on MacDonald, both post fight, and early this morning, showing that, while there was some swelling to MacDonald's eye at the time of the blow taken from Penn early in the 1st round, that any swelling had all but completely subsided by this morning, and MacDonald was not suffering from any concussion, or any ill effects from the fight the previous night, asserting that MacDonald could have, and should have, been allowed to continue. MacDonald has been cleared to fly back home to Canada this afternoon. We'll keep you posted on any other developments as they come in.

ManMMA has spoken a length with the Global Commission, the Governing Body, the ring-side referee that stopped the fight, and Dan Miragliotta. Our detailed findings are as follows: While it is entirely possible Rory is able to fight TODAY, at the time of the stoppage, he had sustained substantial damage to the head region, particularly to the eye. This was visible damage, as referee Dan Miragliotta was uncomfortable enough with the appearance of the damage to request a doctor examine it. At which time, the doctor, a certified medical expert, declared Rory was not capable of continuing to fight safely and fairly at that time, with the swelling his eye had sustained. Immediately upon completion of the fight, a medical debriefing was presented to ManMMA for insurance purposes, and Rory's immediate post-fight medical scan supports this conclusion. This report is submitted by an independent medical team, not the cage-side doctor who stopped the fight. Collectively, they concluded that the damage received to Rory's head was classified as "high" level of concern. in their notes we can also see they have specifically listed the primary (and only) area of high-level concern as being a "swollen eye". As such, we have no choice but to agree with the medical experts in their post-fight medical findings, and concur that the TKO stoppage was not only justified, but also necessary. ManMMA cares about the safety of our fighters first and foremost. We don't want fighters with high-level injuries fighting on, trying to die on their shields. We want them to be able to grow, and progress. And defend their belts when they win them. We are happy to hear that Rory has now healed well, and can get back in the gym for improvements. We know Rory will be back and better than ever, and look forward to seeing his improvements in upcoming fights. There are whispers of a grudge match at Zenith vs. Khabib, and if those are true, we know our home base at the sold-out SkyDome in Toronto will be excited to see what the Canadian brings to the table to stamp out the streaking Russian juggernaut. Upon hearing of the "findings" of ManMMA, Phoenix FC has announced they will now be filing a formal protest & grievance of this ruling with ManMMA. GM Kruzer declined an interview at this time but stated via email to ManMMA.com that: "This is not over. ManMMA has received Rory's MRIs from the same medical staff that cleared him to travel from Peru this morning. If he had sustained the allegedly injuries that they're "independent medical staff" claim, he would not have cleared to travel back home this quickly.
Phoenix FC is fully prepared to take this to the courts, if need be."

Statement from ManMMA's Director of Medical Oversight and Fighter Safety:
We understand there is a gross misunderstanding from Rory's camp about how we deal with eye swelling, and we would like to provide some clarity.
First and foremost, an MRI is irrelevant in determining whether a fighters eye was too closed to continue to fight safely. MRI is an internal organs scan. The fight was not stopped from a concussion, brain injury, or damage to any internal organs. It was a swollen eye - indicating Rory was unable to see.
Even if Rory was able to see 2 minutes after the fight was stopped, the commission's doctors, backed up by the medical document provided, testified that Rory was clearly unable to see sufficiently enough to continue the fight at the time he was examined. This is the key component here, since this is when he was in medical danger via dangerously impaired vision. Even if Rory's team is able to come up with new scans now, indicating that his eye is healed, it does nothing to demonstrate he was fit to continue at the time of the stoppage. Such additional information is completely irrelevant to the stoppage at hand. So much so we would actually start to question the validity and integrity of any doctors advising Rory's team that an MRI, or 24-hour-later scans of an eye would be of any value in appeals whatsoever.
As medical professionals, speaking from a medical perspective, Rory MacDonald sustained too much damage to his eye to continue to see clearly and fight safely for this to carry on.
We consider this matter very cut and dry in this instance, for the reasons stated above, as well as the official and certified documents presented prior, and consider this case closed.
